Warranty and Returns Agreement

The following Warranty and Returns Agreement applies without prejudice to, and is subject to, the Terms of Service; together they form part of the Agreement (see Terms of Service Section 1 and 2). Terms defined in the Terms of Service and also used herein shall have the meaning as defined in the Terms of Service.
1. Statutory Right of Withdrawal
If you are a consumer residing in the EEA or UK you have the following right of withdrawal when purchasing a product from us though our website. The statutory right to withdrawal does not exist or lapse, as the case may be, in the case of contracts regarding the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
1.1 Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
To exercise the right of withdrawal, you must inform us Daily Paper Retail B.V., Bilderdijkstraat 131, 1053 KN, Amsterdam. [email protected], of your decision to withdraw from this contract by an unequivocal statement (e.g. by using the return form, a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
1.2 Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to the company commissioned by Daily Paper Retail B.V. – Promese Logistics, attn. return department, Flight Forum 2500, 5657 DZ Eindhoven, The Netherlands – without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

2. Additional Warranty and Returns Agreement
The terms of this section apply in addition to, and do not limit any, statutory return and/or warranty and return rights you might have under applicable law, including the statutory right of withdrawal under EU and UK consumer law pursuant to Section 1 of this Warranty and Returns Agreement.
2.1 Voluntary Return Policy
2.1.1 Scope
As part of our additional voluntary returns policy ("voluntary returns policy"), we accept returns of products purchased though our website or in our stores for any reason and issue a refund or store credit if the following conditions are met.
Anything that has been purchased online can also be returned to our warehouse. Within 14 days, orders may be returned, and we will offer a refund if we receive an item purchased by you from us and returned to us and the below conditions are met. To send the item back under our voluntary return policy please fill in the return form you received with your order and send the item back by post or courier to the relevant address. Instructions on how to send it are on the return form. Please note that:
- Surf Ghana products are exempt from our voluntary return policy.
- All products must be returned within 14 days of receipt.
- All products must be unworn and unwashed, undamaged, unaltered, unsoiled, and unused (other than from carefully trying on the product(s) on and in the same state that it was sold to you).
- All products must have all original labels, including the Daily Paper tags, still intact and attached.
- For hygiene reasons, underwear briefs, bodies, swimwear and facemasks cannot be returned or exchanged unless faulty.
- The product(s) should be returned in or with the original packaging.
- Shipping back to our warehouse is at the customer’s own cost.
- Save your tracking code link as proof of shipping.
2.1.1 Returning your order at the Daily Paper store
At this moment, it's not possible to return orders made online in our New York & London stores. For New York & London stores, only purchases made in-store can be returned or exchanged in store.
Our Amsterdam store is able to take returns of online purchases in store. In addition, you can exchange size in the store if you bought online in the Netherlands.
Sales items or other reduced price items purchased online cannot be returned to our Amsterdam store. However, if you purchased such item(s) from the Amsterdam store, you can return it there.
2.1.3 Late or Missing Refunds
As soon as we have received and approved your return, it will take approximately 7 to 10 business days to process your refund.
In the event that you haven't received a refund yet, first check your account balance with the payment method you used. Please note that it always takes some processing time before a refund is issued. In the event that you have already contacted your payment carriers and banks but still have not gotten your refund yet., please get in touch with us via our email address [email protected].
2.1.4 Standard Refund Method
Refunds will be issued to the same method of payment and the same credit or debit card as the original purchase (except for gift cards and e-gift cards, in which case you will be refunded a credit onto a new gift card). Shipping charges and sales tax on shipping are not refundable.
2.2 Damaged goods during shipment
Make sure you check your item(s) once you receive your package. Any damages from shipment and/or delivery must be notified to us. In the event that you receive your item(s), and they have been damaged during shipment, please email to [email protected] immediately. Include an image and description of the damaged goods. This information is very important to us in ensuring that our items are bundled and sent appropriately. We will issue a refund for the damaged goods and you can make the order again.
2.3 Warranty
Daily Paper products are produced to professional standards and in consideration of the product. Our proven and reliable design and manufacturing techniques ensure that we provide our clients with high quality garments that have excellent properties.
All Daily Paper products meet our quality and fit standards and are tested on tearing, pulling, and snagging. In cooperation with external laboratories, we test our garments to ensure our collections meet the latest legal, chemical and safety standards.
Should there nevertheless be any complaints at some point, please contact our Customer Service Team. Please note that if you are a consumer residing in the European Economic Area or the UK, your statutory warranty rights under applicable law apply.
Voluntary Warranty Policy
Scope of the voluntary warranty policy
Daily Paper products are produced to professional standards and in consideration of the product. Our proven and reliable design and manufacturing techniques ensure that we provide our clients with high quality garments that have excellent properties.
All Daily Paper products meet our quality and fit standards and are tested on tearing, pulling, and snagging. In cooperation with external laboratories, we test our garments to ensure our collections meet the latest legal, chemical and safety standards.
For all customers, all Daily Paper products come with a twelve (12) months service warranty. Under this voluntary warranty policy, Daily Paper will replace those items that have been accepted as faulty by the Customer Service Team in accordance with the terms and conditions described below.
If Daily Paper has accepted claims in accordance with the terms and conditions of this warranty, and if these claims are made within twelve (12) months from the date of ordering, the item(s) will be replaced without charging any cost to the customer including shipping costs.
2.3.1 Recommendations
Each item has a care label. We strongly recommend you to always follow the instructions on this label. If you have additional questions or you want further advice, contact our Customer Service Team (see Sec.3 below) for advice before washing the item.
2.3.2 Requirements for acceptance of claims under this voluntary warranty policy
We will not accept a product as faulty under our voluntary warranty policy if the product was damaged whilst being used in a way that it was not intended for. The intention of use is at the discretion of Daily Paper and will be judged in a reasonable way.
Further requirements for all claims under this voluntary warranty policy are:
- The item was used under normal conditions.
- During the use of the item the care label was strictly followed.
- The claim was directly reported after the fault occurred.
- There is proof of purchase of the item.
2.3.3 Explicitly excluded from this voluntary warranty policy:
- Any claims resulting from irregular use, for example:
- Not following our wash & care instructions
- Extreme weather conditions
- (Extreme) sports
- Sharp objects
- Chemicals
- Damages due to poor storage or neglect
- Poor maintenance
- After modification or repairment of the product
- Damages due to compression, a fall, abnormal impact or actions
- Wear against abrasive surfaces
- Damage caused by UV (sunlight or other natural phenomena), fire, bleach
- Natural breakdown of colors, finishes and materials over time
